Krater Terms of Use

Who we are

These terms are the agreement between you and Krater. Krater is run by BIJVOETS THOMAS, a sole proprietorship registered in Rome, Italy (P.IVA 18706061001), Via Federico di Donato 18, 00151 Roma, Italia.

By creating an account, continuing as a guest or using joinkrater.com, you accept these terms and agree to our Privacy Policy, which explains how we handle your personal data.

Who can use Krater

You must be 18 or older to use Krater, as a member or as a guest.

• Give a working email address when you sign up, and keep your sign-in details to yourself. You're responsible for what happens under your account.
• One person, one account. Extra accounts to dodge a suspension or to push ratings up or down aren't allowed.
• Guests can browse the catalogue without an account. Everything else, including Krappy, needs an account.
• You can delete your account at any time in Settings.

Your content

What you write on Krater stays yours. Your reviews, notes, lists, descriptions, bio and profile picture belong to you.

• The licence you give us. You give Krater a free, worldwide, non-exclusive licence to store, copy, show and adapt your content, only as needed to run Krater and to show it to the people your settings allow. It ends when you delete the content or your account, except for backup copies until they're overwritten, moderation records we must keep, and posts in Krater's own channels that were already published, which we remove if you ask.
• Krater's own channels. We may show your public reviews, credited to your username, in Krater's own channels: the App Store listing, our website, our social media accounts and our promotional videos. We may shorten a review, but never change what it says. If you'd rather a post didn't feature you, email us and we'll remove it.
• Paid advertising. We'll never use your content or username in paid advertising, or suggest you endorse Krater, without asking you first.
• What you promise. You have the right to post what you post, and it follows the rules below.

What's allowed and what isn't

Krater allows as much as it can. Harsh criticism, strong opinions, swearing, dark humour, spoilers, political opinions and heavy topics are all fine.

These are not allowed, in reviews, notes, lists, descriptions, usernames, bios or profile pictures:

• Illegal content, including illegal hate speech, threats, terrorist content, defamation, publishing someone's personal details, and links to pirated copies.
• Harassment aimed at a specific person.
• Pornography, and anything sexual involving minors, which we always report to the authorities.
• Spam, scams and malware links.
• Pretending to be someone else.
• Hidden advertising: paid or rewarded reviews that don't say so, and fake accounts to manipulate ratings.

Creators are welcome. If you review a video from your own channel, say so in the review, for example "my own video". Otherwise it counts as hidden advertising.

Reporting and moderation

Anyone can report content that breaks these rules, and a person reviews every report. Nothing is removed automatically. Please report honestly: we may stop handling reports from someone who keeps sending false ones.

• Members report with the Report button on a review, list, profile or video.
• Anyone without an account can email support@joinkrater.com. Include what it is and where (a link or username), why you think it breaks the law or these rules, your name and email address, and a statement that you believe the report is accurate and complete.
• What we can do: keep the content; hide a review or list (its author still sees it); hide a profile so others see only the username; reset an offensive username; or take a video out of the catalogue. We don't delete your content for you.
• You'll be told. If we hide something of yours, you get a notice in the app with what was hidden and why. The person who reported it hears whether we kept or hid it, and never learns your details from us, nor you theirs.
• Disagree? Email support@joinkrater.com within six months. A person looks at it again and replies.
• If content suggests a real threat to someone's life or safety, we pass it to the police, as the EU Digital Services Act requires.

Suspending and closing accounts

We act on content first. A person always makes the decision about an account; nothing happens to it automatically. Accounts are suspended, not banned, with one exception.

We also follow orders from courts and authorities. While suspended, you can still see your library and ask us for a copy of your data, but you can't post, rate, list, follow or like. We tell you in the app why, and for how long, and you can contest it by email as described above. A closed account can't come back under a new one.

You can stop using Krater and delete your account whenever you like. If Krater itself ever shuts down, we'll tell you at least 30 days before, stop selling subscriptions, and send you a copy of your data if you ask.

Subscriptions and payments

Pro and Hacker are monthly subscriptions sold through Apple's App Store, which handles all payments.

• Renewal: a subscription renews automatically each month at the price shown, until you cancel. Payment is charged to your Apple Account.
• Cancelling: in your iPhone's Settings, tap your name, then Subscriptions. Cancel at least 24 hours before the renewal date to avoid the next charge. You keep your plan until the end of the period you paid for.
• Free trials: if a trial is offered, it turns into a paid subscription when it ends unless you cancel before.
• Refunds are handled by Apple under its terms, at reportaproblem.apple.com. Your rights as a consumer, including any right of withdrawal, are exercised through Apple as the seller.
• What each plan includes is shown on the tier screen in the app. We may change features or limits. For a change that reduces a paid plan, we tell you at least 30 days before it takes effect, and you can cancel before then.
• Deleting your Krater account doesn't cancel your Apple subscription; cancel it separately.

Krappy and AI summaries

Krappy and video summaries are made by AI, and AI makes mistakes. Answers and summaries can be wrong, incomplete or out of date, so check anything important yourself; they aren't professional advice of any kind. Krappy's answers are for your personal use within Krater.

YouTube

Krater uses YouTube API Services. By using Krater, you agree to be bound by the YouTube Terms of Service.

• Krater isn't affiliated with, endorsed by or sponsored by YouTube or Google.
• The videos belong to their creators and play on YouTube. Krater only shows information about them, such as titles and thumbnails.
• A video can disappear from Krater when it's removed or made private on YouTube, and your entry for it may then show that it's unavailable.

Ads

Ads pay for the free plan. In the app, free members see them and guests and Pro and Hacker members don't; the public pages of joinkrater.com can show them to everyone. Ads come from Google AdMob in the app and Google AdSense on joinkrater.com, and your choices about personalised ads are explained in the Privacy Policy. We aren't responsible for advertisers' products or websites.

Krater's own rights

The Krater app, name, logo, Krappy and the design of the app belong to BIJVOETS THOMAS. You may use Krater as intended, but not copy, resell or reverse-engineer it, or scrape it with automated tools. If you send us ideas or feedback, we may use them freely, without owing you anything.

Liability

We work hard to keep Krater running well, but we can't promise it will always be available, error-free, or that every video will stay on YouTube.

• Nothing in these terms limits our liability for intent or gross negligence, for death or personal injury, or anything else the law doesn't allow us to limit. Your statutory rights as a consumer always apply.
• Otherwise, for free use we're only liable for what the law requires, and for a paid plan our total liability is limited to what you paid us in the 12 months before the problem.
• We aren't responsible for content posted by other members, for YouTube videos, or for other companies' services that Krater links to.

Changes

Krater keeps developing, so features can be added, changed or removed.

• When we change these terms in a way that matters to you, we tell you in the app at least 30 days before the change applies, unless the law or a safety issue requires it sooner.
• If you don't agree with a change, you can delete your account before it applies. If you keep using Krater afterwards, the new terms apply.
• Each version is dated at the top of this page.

Governing law and disputes

These terms are governed by Italian law. If you live in another EU country, you keep the protection of the mandatory consumer laws of that country, and you can bring a claim in the courts where you live.

If something goes wrong, email us first at support@joinkrater.com; most problems can be solved that way.

General

• These terms and the Privacy Policy are the whole agreement between you and Krater.
• If a court finds part of these terms invalid, the rest still applies.
• If we don't enforce a rule straight away, we can still enforce it later.
• We may send you notices in the app or by email, and they count as written notice.
• If Krater is ever transferred to another owner, we'll tell you first. Your rights under these terms stay the same, and you can delete your account if you don't agree.
